Pennsylvania Commonwealth Court Affirms Court of Common Pleas Decision to Set Aside Tax Sale

July 14, 2025, 3:00 PM UTC

The Pennsylvania Commonwealth Court affirmed the Court of Common Pleas of Delaware County’s decision to set aside an upset tax sale. The sale occurred because the tax claim bureau mistakenly reported that the taxpayers were delinquent on their 2019 property taxes, when in fact the taxes had been paid. The court found the tax sale void since the taxes were paid, allowing the petition by the taxpayers and mortgage holder to set aside the sale. [Apex Mortg. Corp. v. Del. Cnty. Tax Claim Bureau, Pa.
