The Pennsylvania Commonwealth Court vacated the trial court’s denial of a petition to intervene in a proceeding involving a scheduled private sale by the highest bidder in a tax upset sale. The Commonwealth Court found that the trial court’s denial of the petition to intervene was a deprivation of the right to appeal an order that negated the bidder’s interest in the property and effectively put the bidder out of court.
