A decision giving a state university a break from stormwater fees could have environmental repercussions across Pennsylvania if the state’s high court doesn’t intervene, a municipality and its supporters argued in briefs made public Wednesday.
West Chester wants the Pennsylvania Supreme Court to overturn a decision of the Pennsylvania Commonwealth Court that the fees are a tax from which West Chester University is immune as a government entity. The commonwealth court improperly started its analysis with the faulty presumption that the fee is a tax, the borough argued in its opening brief to the high court.
