Republic Airways’ Property Tax Appeal Revived by Indiana Court

Republic Airways Holdings Inc. will get another chance to challenge termination of its property tax abatement for a training center at the Indianapolis airport, after the Indiana Court of Appeals revived its case.

A state trial court agreed with the Metropolitan Development Commission of Marion County, dismissing the case because Republic and Exploration Center I LLC didn’t do enough to effectuate the appeal. But the statutory language that an appeal “shall be heard and decided within thirty days” is directory rather than mandatory, Judge Robert R. Altice Jr. wrote for the appeals court in an opinion released Friday.
