School Districts Lack Hook to Challenge Colorado Tax Law

Colorado school districts and other political subdivisions can’t participate in challenging a law requiring voter approval for tax increases because they’re not authorized to do so, the full Tenth Circuit ruled Monday.

Neither the U.S. Constitution nor the statute setting up the state of Colorado allows them to sue the state over the law, Chief Judge Timothy M. Tymkovich said for the 7-2 appeals court.
