Texas Solar Power Applicant’s Property Tax Suit Denied by Court

Texas didn’t act beyond its authority when rescinding a certificate that approved a property tax break for a proposed $520 million solar-powered project because inaccurate applicant information invalidated the application, a state appeals court said.

ENGIE Solar NA LLC had merged with an affiliate after submitting its application, changing its name to ENGIE IR Holdings LLC. Since the name no longer matched the one on the application, it automatically invalidated the certificate which provided a tax appraisal limitation, the Texas Court of Appeals, Fifteenth District said.
