Virginia Tax Commissioner Determines Corporate Income Taxpayer’s Form RDC Was Untimely, Denies Research, Development Credits

The Virginia Tax Commissioner Jan. 18 determined in a letter ruling that the Department of Taxation rightfully denied Taxpayer’s application claiming corporate income tax credits. The department received Taxpayer’s Form RDC, Application for Research and Development Expenses Tax Credit, on Sept. 8, 2022, without a postmark. The form filing deadline was Sept. 1, 2022. The department denied the application as untimely. Taxpayer appealed, contending that it mailed the application on Sept. 1, 2022, using the U. S. Postal Service.
