The West Virginia Tax Division March 1 released form WV IT-104.1, Low-Income Earned Income Exclusion Certificate, Election to Not Withhold State Income Tax, with instructions, for individual income tax purposes. Individuals, heads of households, and married couples, who have federal adjusted gross income of $10,000 or less for a taxable year may receive an earned income exclusion. If married and filing separately, federal adjusted gross income may not exceed $5,000. Taxpayers must give this form to their employers.
