Atlanta Water Tax Fee Suit Revived by Georgia Supreme Court

An Atlanta resident’s suit accusing the city’s water and service fees of being unlawful taxes was revived for new proceedings because the trial court denied the accurate facts of the case, the Georgia Supreme Court held Thursday.

The trial court wrongly concluded that A. Thomas Jones hadn’t paid the disputed charges and therefore couldn’t sue for a tax refund, Justice Verda Colvin said. The lower court based its decision on Jones’ bill which didn’t show itemized charges, but that doesn’t conflict with Jones’ allegation that the taxes are hidden, the opinion said.
