BTAX OnPoint: 199A Regulated Investment Company Rules Finalized

The IRS has finalized rules aligning tax treatment for those who use regulated investment companies to invest in real estate investment trusts with those who invest in the trusts directly.

A real estate investment trust (REIT) is a company that owns or often operates income-producing real estate. The rules (T.D. 9899) allow a regulated investment company (RIC) to act as a conduit and “pass through” any qualified REIT dividends it earns as Section 199A dividends. The rules also provide special computational rules.
