California Taking Aim at UPL in Targeting Immigration ‘Notarios’

California lawmakers are debating a bill (A.B. 628) that would restrict who could advise and complete forms for individuals seeking immigration help.

Regulating notarios—non-attorney immigrant advisors—is a big issue for attorneys who argue the consultants are merely unlicensed law practitioners. Immigrant rights advocates argue immigrants are harmed by those presenting themselves in a false light and charging customers high fees. Opponents argue Assembly Bill 638 hurts ethical notarios and those seeking cost-efficient assistance.
