Cannabis Seller Challenges Stacked Missouri County Sales Tax

Only one local government entity can impose a marijuana sales tax on dispensaries within its jurisdiction under the state constitution’s plain language, a cannabis vendor told a Missouri appeals court.

A natural reading of Article 14, Section 2 of the Missouri Constitution shows that a single “local government” can impose a maximum 3% tax on marijuana, Robust Missouri Dispensary 3 LLC said. St. Louis County has misconstrued the constitution by arguing that a county may stack marijuana taxes on top of city taxes on the same products, Robust’s Thursday brief said.
