Cleveland Workers Seeking Tax Refund Interest Get Suit Revived

Nonresident Cleveland workers seeking interest on city income tax refunds for years they worked remotely because of the pandemic had their suit revived by an Ohio appeals court Thursday.

The lower court wrongly dismissed the suit on the basis that the plaintiffs failed to exhaust their administrative remedies, the Ohio Court of Appeals, Eighth District said. The trial court based its decision on material not included in the complaint or an affidavit provided by the city, and is therefore erroneous, Judge Deena R. Calabrese said.
