Conservation Tax Break Challenger Asks Supreme Court to Step In

The Supreme Court should agree to resolve an appeals court dispute over the validity of an IRS rule blocking a wide swath of conservation tax breaks, a Tennessee company urged.

Oakbrook Land Holdings LLC wants the high court to review a ruling from the US Court of Appeals for the Sixth Circuit that upheld the regulation, which the IRS invoked to block the company’s $9.55 million tax deduction. The appeals court said the IRS didn’t need to respond to several public comments on the rule as part of the agency’s rulemaking process because the comments weren’t significant.
