Court Lets Australia Take New Approach to Coca-Cola Tax Case

An Australian court cleared the way for tax authorities to change their case against Coca-Cola Co. and forge ahead with the dispute—after having lost a similar case against PepsiCo Inc. in the nation’s High Court.

The Coca-Cola case will likely now stretch into 2027.

Federal Court Justice Lisa Hespe agreed at a Tuesday hearing that the Australian Taxation Office could argue new grounds. She ordered the ATO and the company to file amended submissions early next year and scheduled another hearing for December 2026 to discuss next steps.
