DaVita Entities’ Drug Purchases Exempt From Louisiana Sales Tax

Five Jefferson Parish dialysis clinics don’t have to pay sales tax on their prescription drugs purchases from a wholesaler because the drugs were administered to Medicare patients, a court of appeals ruled.

A clinic operated by DVA Healthcare Renal Care Inc. and administrated by DaVita purchased dialysis treatment drugs from an AmerisourceBergen distributor during the tax period in question and remitted monthly sales tax payments on those purchases to the parish. DHRC provides dialysis treatment at Chateau Dialysis-Clinic, a Medicare-certified clinic in Jefferson Parish.
