Dentons Attorney Sues IRS for Employee Retention Credit Details

Dentons Sirote PC shareholder Michelle Levin sued the IRS to force it to disclose internal guidance for revenue agents examining returns that claim a Covid 19-related employee retention credit.

The IRS failed to respond on time to Levin’s October 2023 records request under the Freedom of Information Act and the US District Court for the Northern District of Alabama should order it to comply, Levin’s lawsuit filed Wednesday said. The government lacks a legitimate basis for its failure to disclose the materials and hasn’t objected to any of her requests, said Levin, a member of Dentons’ tax practice group.
