Final Rule to Cement Prevailing Wage Overhaul Sent for Review

A rule to finalize the Biden administration’s overhaul of regulations governing how contractors are paid when working on federally funded construction projects is now at the White House budget office, one of the last steps before the regulation goes into effect.

The proposed version of the rule (RIN:1235-AA40), released in March, sought to change how the agency calculates “prevailing wages” under the Davis-Bacon Act. The law requires workers to receive the local “prevailing” rate of pay and benefits when working on certain projects funded by the federal government.
