Hunter Biden Wants Courts to Toss Tax Charge After Trump Ruling

July 19, 2024, 9:13 PM UTC

Hunter Biden is asking courts in Delaware and California to throw out charges of tax evasion, a felony gun conviction, and other charges given a new ruling on President Donald Trump.

Biden told District Courts in Delaware and California that the special counsel that was appointed to pursue charges against him was appointed by the same appropriations clause that was deemed unconstitutional in the recent Florida ruling for President Donald Trump’s charges of mishandling of classified information. That recent decision should also countermand tax evasion charges, the filings said.

A June 11 jury verdict in Delaware found Biden guilty of illegally possessing a firearm, but he’s also accused of failing to pay $1.4 million in federal tax.

In the Trump case, US District Judge Aileen Cannon said the Constitution’s “appropriations clause” requires that no federal money may be spent without approval from Congress.

Biden said in both court filings across that the defect highlighted in the Trump trial “has long eluded other litigants” because so few cases are brought by a special counsel. “The equivalent result should be available” to him, he told the Delaware court.

Dalton & Associates PA represents Biden in the Delaware case, Geragos & Geragos APC represents Biden in the California case, and Winston & Strawn LLP represents Biden in both cases.

The cases are United States v. Biden, C.D. Cal., No. 2:23-cr-00599, 7/18/24 and United States v. Biden, D. Del., No: 1:23-cr-00061, motion to dismiss 7/18/24.
