Idaho Property Owners Seek High Court Review of Wetlands Dispute

Idaho property owners want the U.S. Supreme Court to revisit a ruling concerning the scope of the Clean Water Act’s regulation of wetlands, after a lower court held that their site contained wetlands subject to protection under the law.

The U.S. Environmental Protection Agency previously found Michael and Chantell Sackett’s property near Priest Lake contained wetlands. The agency ordered the Sacketts to stop construction on a home and threatened a $40,000 daily fine if they didn’t comply. The EPA withdrew its compliance order in March 2020 after the Sacketts sued.
