Island Property Tax Foreclosure Appeal Dismissed as Premature

A tax debtor’s father’s appeal to stop the US from foreclosing on his home was premature, because a lower court hadn’t yet ordered the home’s sale, the Ninth Circuit said Wednesday.

In order for Shaun Allahyari to appeal a foreclosure order on his son’s Mercer Island property, the court must issue a final judgment that can be executed without further court input, the US Court of Appeals for the Ninth Circuit said. The order Shaun challenged doesn’t meet that criteria, and so the appeals court ruled that it lacks jurisdiction.
