Michigan Homeowner May Proceed in Tax Foreclosure Class Action

A former property owner who lost her home to resolve a tax debt and sought the surplus proceeds from the foreclosure sale can proceed with her third-amended complaint against Oakland County, Mich., a federal court said.

Marion Sinclair may pursue her claims of federal takings, due process violations, and unjust enrichment against Oakland County, the US District Court of the Eastern District of Michigan said Tuesday. However, a civil conspiracy claim may not be pursued against the county, Judge Terrence G. Berg said.
