New Jersey Landlord Loses Appeal of Bid Protest for IRS Office

The federal government didn’t act in bad faith to move an IRS office out of a New Jersey building, the US Court of Appeals for the Federal Circuit said.

In a brief order, the appeals court upheld the lower court ruling, “relying largely on the Court of Federal Claims’ thorough and detailed analysis of the facts and law.” This leaves in place a 2023 decision that dismissed Bear Mountainside Realty LLC’s lawsuit claiming the General Services Administration acted with “bad faith” to move an IRS office out of its Mountainside, N.J., building because an official didn’t like the space.
