New York Tax Appeals Division Grants Taxpayer’s Petition Regarding Sales Tax Certificate Issuance

The New York Division of Tax Appeals (DTA) March 13 issued a decision granting taxpayer’s petition and cancelling the Division of Taxation’s notice of proposed refusal to issue a sales tax certificate of authority. Taxpayer had filed an application for a sales tax certificate of authority, but the Division refused to issue the certificate because the company’s 100 percent shareholder allegedly owned more than 50 percent voting stock of another corporation that had unpaid New York State tax debts.
