Ohio Justices Do Away With ‘Public Right’ Standing Exception (1)

The Republicans on the Ohio Supreme Court on Thursday did away with a seldom used 25-year-old precedent that permitted lawsuits if a party sought to protect or enforce a “public right,” saying it’s contrary to existing requirements and what the state constitution says about the ability to sue.

The court, in overruling Ohio ex rel. Ohio Academy of Trial Lawyers v. Sheward, limited its power by overruling the exception to traditional standing rules, which say a suing party must show the injury they suffered for the case to proceed.
