Oracle Asks Florida Appeals Court for Software Sales Tax Refund

Oracle America Inc. told a Florida appeals court that it’s entitled to almost $740,000 in sales tax refunds for software it sold because the company isn’t required to return that money to customers before requesting a refund.

The software company should get the sales and local tax refunds because an administrative law judge correctly said it was entitled to one, according to the Monday brief.

The administrative judge found for Oracle on the merits but mistakenly dismissed the company’s petition on the grounds that it didn’t refund its customer before submitting its own tax refund application, the brief said. ...
