Perrigo to Recoup $89.2 Million Following Transfer Pricing Win

Perrigo Co. is entitled to $89.2 million for overpaid taxes, interest, and penalties the IRS wrongly assessed from 2009 to 2012, a federal judge said in issuing a final judgment in a long-running transfer pricing dispute.

Judge Robert J. Jonker of the US District Court for the Western District of Michigan on Tuesday approved a proposed judgment from the IRS and pharmaceutical company following his September 2025 opinion that Perrigo’s transactions with an Israeli affiliate didn’t lack economic substance and thus weren’t simply a tax avoidance scheme.
