The Rhode Island Supreme Court sided with mall operators’ position that they were entitled to a tax exemption even after completing construction of the Providence facility.
The Division of Taxation asked the state’s high court to review a District Court decision that favored the companies. arguing that the state’s Economic Development Corporation tax exemption expired once mall construction was completed and certificates of occupancy were obtained. The state also argued that the trial judge erred when weighing conflicting evidence and comparing various provisions of the general laws and the ground lease.
