Several defendants were correctly ordered to pay more than $50 million and stop promoting abusive tax shelters through a scheme that was advertised as a way for customers to get tax deductions and solar-energy tax credits, the Tenth Circuit ruled.
Neldon Johnson, R. Gregory Shepard, and multiple entities were asking the U.S. Court of Appeals for the Tenth Circuit to reverse a lower court’s order for them to stop promoting an unlawful tax scheme and to disgorge their gross receipts from it. Disgorgement is a form of restitution that’s assessed based on how much the defendants wrongfully gained.
