Spain’s Top Court Removes Barriers to R&D Tax Credit Claims

Spain’s high court ruled against the tax authority’s efforts to limit companies claiming relief for research and development activities.

The Supreme Court’s ruling repealed three earlier sentences by the National Court, which had supported the tax authority overruling a binding report issued by the Ministry of Science and Innovation on technological innovation projects qualifying for tax relief, the court said in a press release Tuesday.
