Supreme Court Rejects Case Over Conservation Tax Break Rule

The US Supreme Court declined to review the validity of a rule the IRS used to deny a variety of conservation tax breaks, despite a split among appeals courts.

The high court’s rejection of Oakbrook Land Holdings LLC’s plea for review came in orders it issued Monday. Oakbrook was challenging a ruling from the US Court of Appeals for the Sixth Circuit that the IRS hadn’t violated the Administrative Procedure Act when it issued a regulation on conservation easement donations. The act requires federal agencies to respond to significant public comments as part of their rulemaking process.
