T-Mobile USA Inc. for the third and final time triumphed in getting a lawsuit over allegedly denied property tax reimbursements dismissed because the third party that submitted the refund claims didn’t have standing to sue, a New Jersey federal judge said.
While T-Mobile purportedly had contracts with landlords that said the company would cover taxes assessed on telecommunications equipment installed on the landlords’ properties, a third party that submitted refund requests on behalf of the landlords can’t sue T-Mobile for breach of contract, the court said.
