The United States lost its bid to remove a taxpayer’s property lien challenge to federal court because the lawsuit was properly served and the government failed to act within the 30-day deadline, a Florida federal court ruled.
The US District Court for the Middle District of Florida said in the Tuesday order that Catherine McEachern’s quiet title suit on a lien could proceed in state court, finding that she properly served her complaint under Tax Code Section 2410, and the government missed a 30-day window to remove it.
