Taxpayers in a southeast Texas school district may sue an overlapping, specialized school district to challenge its constitutional authority to double tax them after the Texas Supreme Court revived their case Friday.
The taxpayers proved a sufficient financial injury to establish constitutional standing to bring the lawsuit, but the school district they live in can’t sue on its own behalf because its alleged injuries were speculative, the unanimous court ruled.
The appeals court didn’t need to resort to the taxpayer standing doctrine just because the claims involve payment of taxes, Justice Rebeca Aizpuru Huddle wrote.
