Toll Brothers Drops FCC Fee Lawsuit After Supreme Court Ruling

Toll Brothers Inc. won’t push its case that fees paid to support the Federal Communications Commission’s Universal Service Fund are an unreasonable taking—after the Supreme Court upheld the fees.

The US Court of Federal Claims dismissed a case brought by Philadelphia-based real estate developer Thursday, after the company filed a voluntary notice of dismissal of its suit. It had originally brought the suit in May alleging it had been damaged by paying the fees.
