Tossed UBS Racketeering Suit Seeks New Life at the Supreme Court

The US Supreme Court should weigh in on whether a couple can pursue RICO claims against UBS AG for unprompted account changes that they say triggered an audit and tax penalties, the couple said in a petition for review.

The US Court of Appeals for the Second Circuit previously decided that Jonathan and Esther Zuhovitzky’s claims under the Racketeering Influenced and Corrupt Organizations Act should be dismissed for failure to state a claim because the couple didn’t draw a strong enough causal connection between UBS and the alleged harms brought by the IRS.
