US Business Challenge to Global Tax Sent to EU High Court

A Belgian court determined Thursday it didn’t have jurisdiction to rule on a challenge to the global minimum tax by US business groups and referred the case to the European Court of Justice.

The American Free Enterprise Chamber of Commerce, Arkansas Chamber of Commerce, California Business Roundtable, Kansas Chamber of Commerce and the Kentucky Association of Manufacturers brought the claim.

The Belgian Constitutional Court found that the application of Belgium’s undertaxed profits rule, including its calculation and allocation, are imposed by the EU’s global minimum tax directive.
