The US Supreme Court on Monday declined to review whether a Michigan law that requires former homeowners to claim surplus proceeds from a tax foreclosure sale within 92 days violates their constitutional rights.
The law’s 92-day mandate is too burdensome a procedure on a protected right under the US Constitution, the former owners said in their petition for high court review.
“Michigan’s statute also conflicts with this Court’s oft-recognized principle that burdening a constitutional right with an opt-in process to preserve the right works the same harm as violating the right directly,” the petition said.
