A Salt Lake City-based oil business is seeking a $130,800 refund for excise taxes it paid on imported diesel fuel, because another company facilitating its fuel sale already paid some tax, its lawsuit said.
Big West Oil LLC told the US District Court for the District of Utah that Elbow River Marketing Ltd. caused nearly 572,300 gallons of diesel fuel to enter the US and made $139,600 in excise tax deposits with the IRS on Oct. 29, 2019.
