Vitol Loses Bid to Revive $8.8 Million Alternative Fuel Tax Case

The Fifth Circuit rejected a request by Vitol Inc. to review a ruling that blocked the energy company from claiming an alternative fuel tax credit for fuel blended with butane.

Vitol sought review of a March panel ruling, which held the company wasn’t entitled to a roughly $8.8 million refund for credits under tax code Section 6426. The company asked the entire U.S. Court of Appeals for the Fifth Circuit to consider the case, arguing that the ruling conflicted with both Fifth Circuit and US Supreme Court precedent.
