West Virginia’s Tax Commissioner waived its right to reply to a Supreme Court petition by a natural gas company that claimed the state can’t deny deductions of post-production expenses because that violates the dormant commerce clause of the US Constitution.
Commissioner Matthew R. Irby on Thursday waived his right to respond to a petition for certiorari filed on Sept. 11 by Antero Resources Corp., according to the Supreme Court docket. The state commissioner provided no reasons for declining to reply.
