Parallel Ruling Undercuts Halliburton’s Tax Refund Bid, DOJ Says

Halliburton Co.‘s challenge to a Treasury regulation as part of its suit for an $11.4 million tax refund should be dismissed because another court has rejected substantially similar arguments, the Justice Department said.

The government‘s Sept. 12 notice of recent authority says a July ruling backing the IRS against another company’s excise tax suit supports its argument that Halliburton can’t challenge a Treasury regulation without first doing so as part of its administrative action seeking the refund.
