SiriusXM Suit Against Auditor Sent Back to New York State Court

A New York judge denied an auditor’s bid to move SiriusXM Radio Inc.'s lawsuit to a federal court because the issue at heart is a “quotidian contract dispute” that doesn’t invoke the Copyright Act.

SiriusXM’s lawsuit against Adeptus Partners LLC, which accuses the auditor of working with the radio company despite a conflict of interest, revolves more around professional accounting standards than a “substantial” issue of federal law, Judge Naomi Reice Buchwald wrote in the opinion filed Nov. 19 in the US District Court for the Southern District of New York.
