Leidos $138 Million Task Order Unaffected by Trump’s RTO Mandate

Leidos Inc. is cleared to perform a $138 million FBI task order for digital and information technology services, the GAO said in a decision released Wednesday.

Protester ManTech Advanced Systems International Inc. failed to show that the FBI should reconsider the award because the agency’s needs changed after President Donald Trump issued a memorandum calling for federal government employees in the executive branch to report to offices for work, the Government Accountability Office said.

ManTech didn’t identify specific circumstances in the presidential memorandum that constituted a material departure from assumptions in the FBI’s solicitation, the GAO said.

The FBI sought bids to provide biometric services under a task order to support the agency’s Criminal Justice Information Services Division in West Virginia. ManTech and Leidos were the only two companies remaining in the competition after “numerous protests and corrective actions,” the GAO said.

ManTech protested shortly after Leidos’ Jan. 24 selection, asserting that the president’s Jan. 20 return to in-person work memorandum “drastically altered” procurement requirements.

But ManTech’s general assertion of changed contractor requirements that allegedly flow from the presidential memorandum is insufficient to form a valid basis for a protest, the GAO said.

The memorandum, and accompanying guidance from the US Office of Personnel Management, address work arrangements for federal government employees, and doesn’t refer to contractors or contractor performance, the GAO said.

ManTech also failed to show that the FBI should have received a higher rating than “some confidence” in the corporate experience factor evaluation, the GAO said.

The FBI reasonably determined ManTech’s proposal lacked sufficient detail to show that a prior contract encompassed the activities in the required in the task order, the GAO said.
