Delaware Amends Family-Leave Law Ahead of 2026 Launch

Delaware is modifying provisions in its family-leave law in preparation for the program’s launch in 2026, under a bill effective July 30.

Gov. Matt Meyer (D) signed HB 128 into law July 30.

Family-Leave Benefits

HB 128 repeals a provision that would have allowed employers to require employees to use any unused accrued paid time off before receiving family-leave benefits. However, an employer and employee may agree to use any paid time off to supplement family-leave benefits, under the bill.

Employer-provided disability insurance policies for employees may allow disability benefits to be offset by any family-leave benefits, under the bill. ...
