A Florida appeals court ruling that the city of Miami Beach’s wage ordinance was preempted by state law was affirmed after the Florida Supreme Court declined to review the case Feb. 5.
The Florida Supreme Court said Aug. 29, 2018, that it would review an appeals court’s ruling that Miami Beach’s 2016 minimum-wage ordinance was preempted by a 2003 Florida statute. The ordinance required private-sector employers to incrementally increase workers’ hourly minimum wages until they reached $13.31 within five years. The state’s hourly minimum wage, which was $8.05 when the ordinance was enacted, now is $8.25.
