Fox News Host’s Job Arbitration Challenge to Be Heard by 2d Cir.

The Second Circuit agreed to review whether a Fox News Network LLC employee must pursue in federal court her bid to invalidate her employment arbitration agreement under New York law, court records show.

At issue is a New York law banning mandatory arbitration of sexual harassment claims and who decides its enforceability.

Andrea Tantaros, a former co-host of Fox’s “The Five,” sued in New York state court in July 2019. The suit challenges a February 2017 ruling in a separate state court case that required her to arbitrate her sexual harassment claims. Tantaros pointed to New York Civil Practice Law ...
