Georgia Enables Gig Worker Benefit Funds Without Status Change

Georgia will let gig companies like Uber and DoorDash contribute to workers’ portable benefits accounts without forfeiting the drivers’ independent contractor status, under legislation Gov. Brian Kemp (R) signed into law.

The measure (HB 987), which Kemp signed Monday, is similar to industry-supported bills considered across the country this year. The bills provide that contributing to a portable benefits account can’t be considered as a factor in determining a worker’s employment status. Traditionally, state and federal laws have treated providing benefits as evidence that a worker should be classified as an employee.
