Hawaii State Contractors Are Liable for Subcontractor Wages Owed

Hawaii state contractors providing private construction work are liable for any unpaid wages owed by their subcontractors under a bill Gov. Josh Green (D) signed June 1 that immediately took effect.

Under SB 415, state contractors are only liable for the amount of unpaid wages and any interest owed on those wages. Subcontractors will be liable for any penalties, liquidated damages, benefit or contribution claims, and any court costs or reasonable attorneys’ fees.

The bill allows Hawaii’s state labor and industrial relations director or a joint labor-management cooperation committee to enforce liability against state contractors. The statute of limitations ...
