Marketer Settles Misclassified Workers’ Lawsuit

A company that marketed mobile phones may settle workers’ wage and hour claims under the Fair Labor Standards Act and California labor laws, a federal district court said Oct. 3.

Sales representatives filed a class and collective action lawsuit claiming that the employer, Open Door Marketing LLC, of California, misclassified them as independent contractors, resulting in failure to pay the minimum wage, overtime pay, and termination pay, and failure to provide accurate itemized wage statements.
